Vividkart trading as VIVIDKART.COM , India (hereinafter “VIVIDKART”) maintains the internet portal WWW.VIVIDKART.COM, an online shopping store (hereinafter “VIVIDKART”). On VIVIDKART.COM customers will be offered widest Range of Quality products across all categories from regional, national and international brands, Wholesalers and retailers. We VIVIDKART.COM aim to consistently deliver a trusted shopping experience to all our customers. The offering on this site is only directed at end users of a legal age. Goods will only be sold in normal household quantities. These terms and conditions find application in all contracts which members enter into via VIVIDKART.COM as well as all general business relationships between VIVIDKART and its customers. VIVIDKART.COM does not accept any other terms and conditions unless explicitly stated otherwise. If periods are stated in working days, these include all weekdays except Sunday and all statutory holidays (Indian).

After you have completed the registration process, you will receive a verification of your registration by email. Once verified you will receive a confirmation of your registration by email. VIVIDKART.COM reserves the right to refuse registration without giving reasons.
You indemnify VIVIDKART.com completely of any claim by third parties on first demand. By transmitting the contents to VIVIDKART.com, you grant VIVIDKART.com all exclusive rights of use over time, space and content without restriction, including transfer to a third party, which VIVIDKART.com requires for publication and dissemination, even in part, to VIVIDKART.com. VIVIDKART.com is entitled to store or release content, and reserves the right of cancellation, reduction, modification or correction of such content.

You are only permitted to register and use one membership account at a time. Multiple registrations will be deleted by VIVIDKART.COM .
Customer can change billing or shipping address at any point of time from my accounton VIVIDKART.com you can access your recently shipped and/or completed orders. In this area you can also change, Password and User information.
VIVIDKART.COM reserves the right to issue a warning, to terminate your membership or to modify or delete content you have submitted, if you violate any of the provisions. Any claims for damages by VIVIDKART.COM remain unaffected.
CONTRACTUAL PARTNERS, LANGUAGE AND CONCLUSION OF CONTRACT
At the conclusion of contracts on VIVIDKART.com your contractual partner is solelyVIVIDKART.com.VIVIDKART.com is operated in English; VIVIDKART.com contracts are concluded exclusively in English. All registered customers will be treated as acceptance of the terms and conditions of VIVIDKART.com.
In cases where prices are displayed incorrectly on VIVIDKART.com due to technical errors, VIVIDKART.com is entitled to action for nullification. The burden of proof regarding an error lies with VIVIDKART.com Payments already made will be refunded immediately.
PRICES AND SHIPPING FEES
For orders on VIVIDKART.COM the prices which are listed at the time of your order on the product page apply. These prices are Inclusive of all taxes and the final price (inclusive of taxes) plus shipping cost are showed in the shopping cart page.

Validity of Offers and Coupons on the products is for limited period VIVIDKART.com regularly updates the offers & coupons page to bring more discounts on various products. VIVIDKART.com offer discount coupons, free gift coupons and many more coupons to make your purchase more satisfying. Each coupon has the expiry date which is mentioned on the each coupon description.
Some coupons can be used in conjunction with other coupons & some coupons cannot be used in conjunction with other coupons. In VIVIDKART.com multiple coupons can be used at a time of order that meets the offer’s eligibility requirements. Eligibility requirement will vary depending on the offer, please be sure to read through the coupons T&C. (Each coupon has different terms & conditions.)
Customer must be registered on VIVIDKART.com to redeem the coupon. If customer facing any trouble using a coupon can call our customer care service or send us an email on info@VIVIDKART.com.
VIVIDKART.COM offers some coupons like welcome coupon for new registered email ids on the vividkart. This coupon codes are unique and will be sent to the customers email id. There are other coupons also which can be used on a particular registered (Account) email id only. These types of coupons are non-transferable and can be used only once.
VIVIDKART.COM reserves the right to refuse delivery and / or to terminate customer accounts should there be a reasonable suspicion of abuse in connection with the use of coupon.
DELIVERY
Delivery will only be given to the shipping address provided by you. It is your responsibility that it is possible to ship to the address during normal working hours. VIVIDKART.COM ships according to the delivery timelines provided for each product/Order. We ensure that we ship as early as possible, but for some orders the timelines are longer due to availability of products or the shipping location.
In cases of force majeure, shipping duration may increase within reason. Force majeure shall include strike, exclusion, official intervention, energy or resource scarcity, shipping difficulties, business complications such as fire or water damage to machinery, lightning or any other unforeseeable business complications for which VIVIDKART.com cannot be held responsible. Starting and ending point of such shipping impediments will be communicated immediately by VIVIDKART.com.
VIVIDKART.com reserves the right to cancel the order delivery due to unavailability of customer after 2nd attempt of delivery. Payments already made will be refunded.
All delivery times mentioned are applicable after confirmation of order from us. For Cash On Delivery orders, this is after we have called and confirmed the order from your end. All order confirmations must be completed within 72 hours. After this time period if order is not confirmed by customer, it is up to the discretion of VIVIDKART.com to cancel the order.
LIABILITIES
VIVIDKART.com is liable only for intent and gross negligence, unless there are fraudulently concealed damages, damages for loss of life, limb or health or damage arising from any infringement of essential contractual obligations. The same applies to violations by VIVIDKART.com’s agents.

CANCELLATION POLICY
Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled shall include limitations on quantities. Availability of product, inaccuracies or errors in product or pricing information, problems identified by our credit and fraud avoidance department or any defect regarding the quality of the product. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after the online payment done, the said amount will be refunded within 72hrs.As part of usual business practice, if we receive a cancellation notice and the order has not been shipped by us, we shall cancel the order and refund the entire amount. Company holds discretionary right to refund the amount via check or bank refund or paytm.
FINAL PROVISION
Should any provision of this agreement be legally void, this does not invalidate the whole contract? Instead, the invalid provision shall be replaced with an effective provision with the same economic purpose. The same applies to possible gaps in this contract.
VIVIDKART.com reserves the right to amend these terms and conditions for future business. Excluded from this are unreasonable changes, especially pertaining to essential contract elements, such as the main benefits owed, which would be subject of a contract modification.
VIVIDKART.com will notify you of changes to the Terms and Conditions in timely fashion. Notification of changes will include a reference to the possibility and the period of objection and the significance or consequences of the omission of contradiction. If you do not contradict the validity of the amended Terms and Conditions within two weeks of the day following the receipt of the notification of change to you, the amended terms and conditions shall be deemed accepted by you.
